1. CONTRACTUAL PARTNER / CONTRACTUAL BASIS

VAULT Events, represented by Mr Michael von der Heydt (hereinafter referred to as the “Organiser”) organises or co-organises a range of event formats shown on this website, each with different requirements for event participation, including age restrictions and dress code requirements

2. SCOPE OF APPLICATION, DEFINITION

a. These General Terms and Conditions (hereinafter referred to as “GTC”) govern the legal relationship between the organiser and the event guests. With the purchase of the ticket for the respective event, a visitor contract for the event is concluded between the organiser and the ticket purchaser. The GTC therefore apply to the purchase of tickets for the respective event by visitors/ticket purchasers and thus to the legal relationship between the organiser and the ticket purchaser. They are an integral part of the visitor contract, which is concluded through the purchase of tickets.

b. The GTC apply to natural persons (private individuals) as well as to companies, merchants, persons acting commercially, legal entities under public law and special funds under public law (companies).

c. Additional or contradictory contractual terms and conditions of the ticket purchaser shall only apply if the organiser has expressly acknowledged these in writing.

d. In order to describe the processes relating to the purchase of tickets (so-called small bearer paper), the term “ticket (pre)sale” is used in the GTC in accordance with common event practice. Legally, the conclusion of the visitor contract is not a purchase contract, but a contract for work and services with a tenancy law element. This is because the desired end result of the visitor contract is not – as with a purchase contract – the transfer of an item or a right to the purchaser’s own assets. Rather, the ticket purchaser is solely concerned with acquiring the right to visit.

e. A ticket is a small bearer instrument within the meaning of § 807 BGB and thus a security that embodies the claim to the service. The ticket exclusively entitles the ticket holder to access the event and to demand the promised service from the organiser. The purchase of the ticket is not primarily about acquiring ownership of the ticket, but about acquiring the right to attend the event and the claim against the organiser to perform the announced event.

3. ACCESS AUTHORISATION

Only persons aged 18 and over are authorised to enter the event on presentation of a valid ticket. Access will be denied if these requirements and proof are not complied with. This only applies if the respective domiciliary rights of the venue are not violated.

4. CONTRACTUAL OBLIGATIONS

a. The services and obligations of the Organiser and the event locations can be found in the respective event announcements, in particular on the Organiser’s website (vault-events.de).

b. The organiser reserves the right to postpone or relocate the event. The postponement will be announced immediately by the organiser on its website and, if possible, in all reasonably accessible media as well as in writing and/or by telephone. Before making major financial outlays for attending the event, e.g. travel and hotel bookings, it is strongly recommended that you consult the website or make a written enquiry to the organiser. If an event is postponed to another date, the ticket is valid for the new event date. The right to return the ticket if the event is postponed is set out in §9 of these GTC.

5. CONCLUSION OF CONTRACT / DUE DATE OF PAYMENT

a. The Organiser’s website(s) and other advertising and notices on event materials and tickets do not contain an offer to conclude a contract, but rather an invitation to the ticket purchaser to submit an offer.

b. Payment of the ticket price and any shipping and handling charges incurred are due upon conclusion of the contract for the purchase of the ticket.

c. As part of the advance sale, all electronic payment transaction costs are to be paid by the ticket purchaser. This includes transaction fees charged by the ticket service partner and/or other payment transaction partners (including credit card companies, banks + other financial service providers) as part of the purchase transaction.

6. TICKET DISTRIBUTION / TICKET DISPATCH WITH OBLIGATION TO GIVE NOTICE OF DEFECTS

a. The sale of tickets for the event in advance and at the box office is always carried out by the organisers.

b. Advance booking fees are to be paid by the ticket purchaser.

c. If tickets are dispatched, this shall be at the expense and risk of the ticket purchaser. The organiser will select the shipping company. The ticket purchaser can only claim obvious errors in the delivered tickets from the organiser within two weeks of receipt of the tickets.

d. If the tickets are sent or handed over to the ticket purchaser before payment of the ticket price, the tickets remain the property of the organisers until full and final payment of the ticket price.

7. INVOLVEMENT OF THIRD PARTIES IN TICKET SALES AND CONTRACT FULFILMENT

The Organiser may commission third parties to sell the tickets on its behalf and also to act on its behalf with regard to other rights and obligations of the Organiser. The contract for the purchase of tickets is concluded between the organiser and the ticket purchaser.

8. PASSING ON OF TICKETS

a. In order to avoid disruptions to the event and criminal offences in connection with attendance at the event, to enforce bans on entry and to prevent the resale of tickets at inflated prices, it is in the interests of the organisers to restrict the transfer of tickets. Ticket purchasers are not permitted to do so:

  • I. to sell tickets at a higher price than the sales price (final ticket price including any advance booking and processing fees) of the organiser,
  • II. to sell tickets commercially or commercially or to use them publicly for advertising or marketing purposes without the express prior written consent of the organisers, and
  • III. to pass on tickets against payment or free of charge to persons who are banned from the event by the organisers.

b. The Organiser is entitled to terminate the legal relationship with the Ticket Purchaser extraordinarily and without notice if the Ticket Purchaser violates Section 8 (a), I – III. In this case, the organiser will block the ticket and deny the ticket purchaser access to the event.

c. The Organiser is entitled to levy a contractual penalty of up to EUR 2,500 per violation from ticket purchasers who pass on and/or offer tickets in violation of Section 8 (a), I – III, unless the violation is not culpable. Further claims for damages remain unaffected by this.

9. TICKET RETURNS/CANCELLATION, POSTPONEMENT, CANCELLATION, TERMINATION OF THE EVENT/CHANGE OF PROGRAMME

a. The return of purchased tickets is generally excluded. Tickets that have expired will not be replaced. Tickets lost by the ticket purchaser or destroyed beyond recognition will not be replaced or refunded.

b. If the event is cancelled or postponed, the ticket price will be refunded on presentation of the ticket. If the event is relocated, tickets can only be returned and the ticket price refunded if the new venue is unreasonable for the ticket purchaser, taking into account his/her interests.

c. If the event is cancelled due to force majeure, either party may withdraw from the contract. In this case, the mutual rights and obligations shall lapse. Each contracting party shall bear its expenses incurred up to that point.

d. In the event of cancellation of the event, the visitor is entitled to a refund of the ticket price paid if the cancellation occurs in the first third of the event. The cancellation must be proven by presenting or sending in the tickets and must be asserted within 14 days of the cancellation of the event to the organiser or the advance booking office commissioned by the organiser that procured the ticket. The organiser shall be liable in the event of cancellation of the event in accordance with §14 of these GTC.

e. Changes to the programme are subject to artistic freedom and are variable with regard to the participating artists. The organiser reserves the right to change the line-up of performing artists. Changes according to §9 paragraph b + c do not justify a claim for redemption or exchange of tickets.

10. DRESS CODE

a. At selected events, a binding dress code specified by the organiser and the respective event information applies as a prerequisite for participation. In such cases, conventional everyday clothing such as (modern) suits, jeans, T-shirts, trainers, etc. or garish costumes and carnival costumes matching the specified dress code are undesirable.

b. In the event of violations in accordance with §10 paragraph a, the organiser or the staff authorised by the organiser is entitled to request the visitor to change into a wardrobe that complies with the dress code. If the visitor does not comply with this request, the organiser or the persons authorised by the organiser are entitled to expel the visitor from the event. In this case, these ticket purchasers/visitors are not entitled to a refund of the admission fee already paid or to any other compensation or reimbursement of expenses.

11. EVENT REGULATIONS

a. The organiser has the domiciliary rights within the event area to the extent necessary for the safe execution of the event, in addition to the domiciliary rights of the owner and/or operator of the event location. The organiser is obliged to ensure that the event is carried out properly and safely within the event space provided. The organiser is also obliged to enforce the respective house rules of the owner or operator of the event location vis-à-vis the visitors. In the event of breaches of the house rules, it must take the necessary measures to prevent further breaches.

b. The following general behavioural obligations apply to the event:

  • I. The carrying of dangerous or illegal objects, in particular drugs, weapons and explosive substances, as well as drinks and foodstuffs not belonging to the event is not permitted.
  • II Animals are not permitted on the premises.
  • III. entering the stage area and the stage area is prohibited.
  • IV. Ticket purchasers are prohibited from carrying items of any kind on the event site with the intention of offering them for sale or using them in any other way for commercial purposes. Items carried with this intention or actually offered for sale may be removed by security personnel and other authorised persons or taken into custody until the end of the event.
  • V. Furthermore, the ticket purchaser is prohibited from organising musical or artistic performances or other performances and displays aimed at a large number of people on the event site.

c. In the event of infringements of points I – V, a contractual penalty of EUR 1,000 shall be payable immediately. The organiser expressly reserves the right to assert further claims.

d. The Organiser may expel ticket purchasers/visitors from the venue who violate the house rules of the respective venue, the safety regulations of the Organiser Regulations of these GTC or the instructions of the security staff. These ticket purchasers are not entitled to a refund of the admission fee already paid or to any other compensation or reimbursement of expenses.

12. PHOTO/IMAGE, SOUND AND FILM RECORDINGS OF VISITORS

By purchasing a ticket for an event organised by the event organiser, the ticket purchaser agrees that visual and acoustic recordings and photos made during the event may be used by the event organiser for media and advertising purposes (= own reference use). The visitor’s consent relates only to incidental or incidental recordings of the visitor during the event recording. There is no obligation to pay remuneration.

13. PROHIBITION OF PHOTO/IMAGE, SOUND AND FILM RECORDINGS BY TICKET PURCHASERS

a. When attending selected events, ticket purchasers are generally prohibited from carrying smartphones, mobile phones, cameras or other devices with the possibility of taking photos/images, sound and film recordings, as stated in the respective event information.

b. At all other events, visitors are generally prohibited from making image, sound and film recordings or enabling third parties to make such recordings or to transmit, distribute or make them publicly accessible in whole or in part via telemedia such as the Internet or telecommunication services such as mobile networks or to enable third parties to do so without the prior written consent of the organiser.

c. Commercial use of photographs, images, sound or film recordings made at the event venue is prohibited.

d. If the ticket purchaser culpably violates paragraphs 1 to 3, the organiser is entitled to a contractual penalty of up to EUR 3,000 for each violation. Further claims for damages remain unaffected by this.

14.LIABILITY

a. Unless otherwise stated in the GTC and the following provisions, the contracting parties shall be liable in the event of a breach of contractual and non-contractual obligations in accordance with the relevant statutory provisions.

b. The organiser shall only be liable for damages – irrespective of the legal grounds – in the event of intent or gross negligence on the part of the organiser, the legal representative and vicarious agents. The organiser shall only be liable for simple negligence on the part of the organiser, the legal representative and vicarious agents in the following cases.
i. for damages resulting from injury to life, body or health, and
ii. for damages arising from the breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely). In this case, the organiser’s liability is limited to compensation for foreseeable, typically occurring damage.

c. The exemption from liability in accordance with §14 paragraph b also applies to the liability of the organiser’s vicarious agents and legal representatives.

d. The limitations of liability resulting from §14 paragraph b do not apply if the organiser or its representatives have fraudulently concealed a defect or have given a guarantee for the quality of the work. The same applies to claims of the ticket purchaser under the Product Liability Act.

e. The ticket purchaser may only withdraw from or terminate the contract due to a breach of duty that does not consist of a defect if the organiser is responsible for the breach of duty. A free right of cancellation of the visitor from the visitor contract (in particular according to § 649 BGB) is excluded. Otherwise, the statutory requirements and legal consequences apply.

15. DATA PROTECTION

a. The personal data provided by the ticket purchaser for the purchase of the ticket will be stored and processed by the organiser exclusively for the purposes arising from this contract in compliance with the relevant statutory provisions of the Federal Data Protection Act and the Telemedia Act. The personal data of ticket holders will not be passed on to third parties. The only exception to this is the transfer of data to third parties involved in ticket sales and contract fulfilment in accordance with § 7 of these GTC, whereby this is done in accordance with the provisions of the Federal Data Protection Act and the scope of the transfer is limited to the minimum necessary for contract fulfilment.

b. The ticket purchaser has the option of changing, correcting or deleting the data stored by him at any time. The right to erasure of the data stored by him/her does not exist if statutory or contractual retention periods prevent their erasure, or if the data are required for the establishment, content, amendment or processing of the contractual relationship between him/her and the Organiser and must be stored for these purposes.

16. FINAL PROVISIONS

a. The contractual relationship is subject to the law of the Federal Republic of Germany. The place of fulfilment for all claims arising from the contract is Berlin. If no other legally binding place of jurisdiction is established by law, Berlin is agreed as the place of jurisdiction.

b. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remainder of the contract. The invalid provisions shall be replaced by the statutory provisions, if any.
